Absent an agreement to the contrary, a retainer fee is refundable if the work is not performed. Retainer is the basis of authority for an advocate. It limits the authority because it is not for all general purposes for all time. It is therefore specific in nature, e.g. during litigation the advocate is authorized by the client to accept service of proceedings that do not require personal service on behalf of the client. This kind of authority can be expressed, implied, apparent or usual through the usual practice of the advocate while pursuing the instructions of the client.

If I'm going to fight your case, then there will be a fight retainer and that means that i will do everything that i can to work to help you get you out of the mess that you are in. If you have a fight retainer, the first thing that its going to say is the case that you are being charged with and that I'm going to be fighting the case. Occasionally i will be taking depositions and i will be getting discovery in the case. If its a DUI then I'm going to get a DUI video. If theres a video with any witnesses, what have you, regardless of the type of case, I'm going to get those videos. Im going to get CAD videos, Im going to get reports between the police officer and the dispatcher, those are very helpful for those cases where there is a BOLO (be on the look out) So the retainer starts off saying this is what I'm going to do for you. We're going to fight your case. We're going to look for technical deficiencies in the states case, mistakes that the police have made and then i walk down the list. Whats important? Well the price is important, right? It tells you how much you are going to pay and it tells me exactly how much I'm going to receive. If you have a payment plan, it walks you through what your payments are. I dont send out monthly billing statements, that would be too costly, I'm a small business. My billing statement will tell you in your retainer, your payments are going to be for example the first of April and every 2 weeks thereafter. So you know thats on a friday of every 2 weeks after your payment is due on April 1st. It also tells you if you miss court and cause me to do more work than anticipated there could be an additional fee. Now my retainers tend to be all inclusive, it has everything, however here's an example, Lets say that i am fighting a case and you had a grand theft charge and maybe they've alleged that you've taken something out of Macys and the value is more than $300. Well while you are on probation you pick up a new charge. Well you've paid me for the grand theft but you haven't paid me for the bond revocation hearing which is going to come and you haven't paid me for the new case. Somehow folks once in a while they get mixed up and say: oh I've paid you to be my lawyer. Well you did pay me to be your lawyer on this case, and that is what I'm going to do but if you get a bond revocation then the state files a motion asking the judge to revoke your bond and put you in jail. Well thats not something thats contemplated. So now there would be an extra small fee associated with that. Additionally, i let people know what their cost money is going to do. Now costs in the state of Florida for state attorneys is expended by the attorney on the clients behalf. So for instance : if I'm taking depositions i have to hire a court recorder, i have to hire a processor, i have to pay witness fees. Theres all kinds of things that go, things such as parking, if I'm going to a courthouse thats not right down the street from my office, now you have a mileage thing because i might be traveling from other counties, maybe I'm traveling to other states to defend your case. So those are all things that your costs are used for. Another things that i tell my clients is that all of my calls are recorded, I want them to know that everything that we say to each other is confidential but its recorded. My retainer goes through everything, and if you keep up with your payments then i ask for 2 things of all my clients. The first thing is that i ask you to pray that i do the best job that i can do. And the second, is pay me, and if you pay me then i am going to do the best job that i can do. I like the prayer because i believe in God. I want to do the case to the best of my ability. Sometimes that means getting someone into a diversion program where the case is going to get dismissed, maybe after a couple months or possibly up to a year. Sometimes thats not an option and i have to be very picky. Sometimes folks go : hey whats taking so long Need an attorney? Then you need a retainer. A retainer protectseveryone. Request a retainer. The retainer spells out whats is expected from both parties and how much the law firm will receive and what they will do for that compensation.
